These Terms and Conditions define the rules for using the SL PRINTS online store (hereinafter: "Store"), operated by Grzegorz Ługowski, conducting business under the name Grzegorz Ługowski Omniflow, NIP: 5492488411, REGON: 543683464, address: Kamieniec 59, 32-650 Kęty, Poland (hereinafter: "Seller"). These Terms have been prepared in accordance with Polish law on the provision of electronic services and consumer rights legislation.
1. Definitions
- Store – the SL PRINTS website available at slprints.pl.
- Seller – Grzegorz Ługowski, conducting business under the name Grzegorz Ługowski Omniflow (NIP: 5492488411, REGON: 543683464), registered at: Kamieniec 59, 32-650 Kęty, Poland.
- Customer – a natural person, legal entity, or organizational unit making a purchase in the Store.
- Consumer – a Customer who is a natural person making a purchase unrelated to business activity.
- Product – an artwork, print, or other service offered in the Store.
- Order – a Customer's declaration of intent to conclude a sales agreement.
2. General Provisions
Using the Store requires a device with internet access, a web browser supporting JavaScript, and an active email address. The Seller makes every effort to ensure the Store operates correctly and without interruptions.
3. Products and Services
The Store offers art prints, canvas paintings, and commissioned works. All products are original works or authorized reproductions hand-signed by the artist. Prices listed in the Store are gross prices and include VAT. Shipping costs are displayed separately before order finalization.
4. Placing Orders
Orders can be placed through the online Store or via email. Placing an order constitutes an offer to conclude a sales agreement. The agreement is concluded upon the Seller's confirmation of order acceptance.
5. Payments
The Store enables payment through external electronic payment operators. The Seller does not store payment card data. For custom orders (commissions), a 50% deposit of the order value is required.
6. Fulfillment and Delivery
Order fulfillment takes 3 to 14 business days, depending on the product type. For commissioned works, the timeline is determined individually. Products are professionally packaged to ensure safety during transport. The risk of damage or loss passes to the Customer upon delivery.
7. Right of Withdrawal
Consumers have the right to withdraw from the agreement within 14 days of receiving the product without providing a reason. The right of withdrawal does not apply to custom-made products (commissions). To exercise the right of withdrawal, please inform the Seller via email. The product must be returned in undamaged condition, in its original packaging.
8. Complaints
The Seller is liable for physical and legal defects of products in accordance with the provisions of the Civil Code on warranty. Complaints can be submitted via email to contact@slprints.pl. Complaints will be processed within 14 days of receipt. In case of a justified complaint, the Customer is entitled to repair, replacement, price reduction, or withdrawal from the agreement.
9. Copyright and Intellectual Property
All works, graphics, photographs, and content published in the Store are the intellectual property of the Seller and are protected by copyright law. Purchase of a product does not constitute a transfer of copyright. Reproducing, copying, or distributing content from the Store without the written consent of the Seller is prohibited.
10. Personal Data Protection
The principles of personal data processing are set out in the Privacy Policy available on the Website. By placing an order, the Customer consents to the processing of personal data to the extent necessary for order fulfillment.
11. Liability
The Seller makes every effort to ensure the highest quality of offered products. Product photographs are illustrative and may slightly differ from the actual appearance (differences resulting from monitor settings). The Seller is not liable for damages resulting from improper use of the product.
12. Dispute Resolution
Any disputes between the Seller and the Customer will be resolved amicably. If no agreement is reached, the Consumer may use out-of-court complaint resolution methods, including the ODR (Online Dispute Resolution) platform available at ec.europa.eu/consumers/odr. The court competent to resolve disputes is the court with jurisdiction over the Seller's registered office.
13. Transaction Security
The Store uses SSL/TLS encryption to ensure data transmission security. Payments are processed through certified payment operators meeting PCI DSS standards.
14. Changes to Terms and Conditions
The Seller reserves the right to amend these Terms. Customers will be informed of any changes with appropriate notice through the Website or via email. Orders placed before changes take effect will be fulfilled under the previous terms.
